Terms of Service

These Terms of Service ("Terms") govern fixed wireless Internet service provided by Reliable Internet, LLC ("Reliable Internet," "we," "us," or "our") to the customer ("Customer" or "you"). These Terms apply to both residential and business customers unless a separate written agreement expressly states otherwise.

1. Service and Scope
Reliable Internet provides fixed wireless Internet access at the service location shown on the Customer's account or service order. These Terms, the applicable service order or account information, the Acceptable Use Policy ("AUP"), the Privacy Policy, and any written service-specific addendum collectively form the agreement between Reliable Internet and the Customer.
Reliable Internet does not provide telephone or interconnected VoIP service under these Terms. Any service not expressly offered by Reliable Internet is outside the scope of these Terms.
The Customer is responsible for activity by family members, employees, guests, tenants, and other persons permitted to use the Customer's connection.
2. Month-to-Month Service; Acceptance
Service is provided on a month-to-month basis unless Reliable Internet and the Customer enter into a separate written agreement stating otherwise. There is no fixed service term and no early termination fee under these Terms.
A new Customer accepts these Terms by activating or using the Service, paying for the Service, or otherwise indicating acceptance. Existing Customers accept updated Terms by continuing to use or pay for the Service after receiving notice that updated Terms are available on Reliable Internet's website, to the extent permitted by applicable law.
3. Billing and Payment
Recurring Internet service is billed in advance. Reliable Internet ordinarily issues invoices on or about the 15th of the month, with payment due on the 1st of the following month. The Customer agrees to pay all charges shown on the account by the stated due date.
Reliable Internet does not assess a routine late fee. Returned checks, reversed payments, or chargebacks may be assessed the actual bank or payment-processing fee incurred by Reliable Internet. Installation charges and service-call or truck-roll charges may apply when disclosed or quoted to the Customer.
Reliable Internet does not ordinarily add separate taxes, government fees, regulatory fees, or surcharges to the advertised recurring service price unless collection of a separate amount is required by applicable law or is otherwise disclosed to the Customer.
4. Nonpayment, Suspension, and Collection
An account is considered delinquent when it remains unpaid for 30 days after the due date. Reliable Internet may suspend Service without additional advance warning once an account is 30 days past due. Recurring charges continue while Service is suspended for nonpayment unless Reliable Internet agrees otherwise.
Reliable Internet does not charge a standard reconnection fee. Reliable Internet may terminate a delinquent account at its discretion any time after the account is 30 days past due.
Unpaid amounts remain due after suspension or termination. Reliable Internet may refer delinquent balances to a collection agency and may recover reasonable collection costs and attorney fees to the extent permitted by applicable law.
5. Cancellation, Proration, and Refunds
The Customer may cancel month-to-month Service without advance notice by telephone, email, or written letter. Cancellation is effective on the date requested by the Customer, subject to any reasonable time needed to process the request and recover company-owned equipment.
If Service is canceled during a prepaid billing period, unused recurring service charges will be prorated through the effective cancellation date. Any unused amount paid for future service will be refunded, subject to amounts otherwise due on the account.
Installation charges may be refundable when cancellation occurs within 30 days of initial activation. Equipment purchased from Reliable Internet may be returned within 30 days, subject to reasonable return-condition requirements. Unless expressly stated in writing, Reliable Internet does not provide automatic service credits for outages.
6. Installation and Access to Property
Reliable Internet may install antennas, radios, cabling, mounting hardware, routers, or other equipment needed to provide Service. The Customer must provide reasonable access to the service location for installation, maintenance, repair, replacement, upgrades, and removal of company-owned equipment.
The Customer is responsible for obtaining any landlord, property-owner, association, or other permission needed for installation on roofs, walls, poles, towers, or other portions of the property. Reliable Internet may refuse or discontinue an installation when the location cannot be served safely or reliably.
The Customer must provide suitable electrical power for equipment required to deliver the Service.
7. Equipment
Unless otherwise stated in writing, Reliable Internet owns equipment installed outside the premises or otherwise designated as company-owned equipment. Equipment installed inside the premises and sold to the Customer is Customer-owned.
Company-owned equipment must remain accessible to Reliable Internet and may not be tampered with, moved, opened, modified, or accessed without authorization. Upon cancellation or termination, the Customer must permit Reliable Internet to recover company-owned equipment or otherwise return it within 30 days. Reliable Internet does not impose a standard automatic unreturned-equipment charge under these Terms, but the Customer remains responsible for intentional or negligent damage to company-owned equipment.
The Customer is responsible for damage caused by abuse, negligence, unauthorized modification, water, improper electrical conditions, or other Customer-caused events. Reliable Internet will replace company-owned equipment that fails through normal use at no additional charge and may repair, replace, relocate, or upgrade company-owned equipment as reasonably necessary.
8. Service Performance and Availability
Internet speeds are advertised as "up to" rates and are not guaranteed minimum speeds. Actual performance may vary due to network conditions, wireless conditions, congestion, weather, power outages, interference, Customer equipment, Wi-Fi conditions, upstream networks, Internet destinations, maintenance, and other technical factors.
Reliable Internet does not guarantee uninterrupted, error-free, or continuously available Service and does not provide an uptime service-level agreement unless a separate written agreement expressly states otherwise. Planned and emergency maintenance may occur with or without advance notice when Reliable Internet determines it is reasonably necessary.
9. Network Management and IP Addresses
Reliable Internet does not impose a general monthly data cap and does not currently maintain a standing policy of traffic shaping, throttling, prioritization, or routine port or protocol blocking. When reasonably necessary to mitigate an active or developing security, abuse, congestion, stability, or operational issue, Reliable Internet may temporarily filter or block traffic, restrict particular ports or protocols, rate-limit affected traffic, or restrict or suspend the affected Service. Any such measures may remain in place for as long as reasonably necessary to protect the network, upstream services, other customers, or third parties and to restore normal operation.
Static IPv4 addresses may be available upon request, subject to availability and an additional charge. IP addresses are assigned for use with the Service and are not owned by the Customer. Reliable Internet may change assigned addresses when technically or operationally necessary. Reverse-DNS service and IPv6 service are not included unless Reliable Internet expressly offers them.
Network-protection measures are applied as circumstances require and may change as network conditions, security threats, and technical requirements evolve.
10. Acceptable Use Policy
The Acceptable Use Policy is incorporated into these Terms and is part of the Customer's agreement with Reliable Internet. The Customer and all users of the Customer's connection must comply with the AUP.
Reliable Internet may immediately restrict or suspend Service, without advance notice, when reasonably necessary to stop an active attack, spam, malware distribution, a serious security threat, material network disruption, unlawful activity, or significant harm to Reliable Internet, other customers, or third parties. For less serious violations, Reliable Internet will normally provide notice and a reasonable opportunity to correct the problem. Repeated violations may result in termination.
11. Customer Responsibilities
The Customer is responsible for maintaining reasonable security for Customer-owned devices and networks, including passwords, Wi-Fi access, routers, computers, cameras, IoT devices, and other Internet-connected equipment. The Customer must promptly notify Reliable Internet of suspected unauthorized use or security issues that may affect the Service or network.
Customers may not operate publicly accessible servers or hosted services, resell the Service, or extend or share the Service with a separate residence, apartment, tenant, business, or neighboring property without Reliable Internet's prior authorization.
12. No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RELIABLE INTERNET DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR A CUSTOMER'S PARTICULAR APPLICATION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELIABLE INTERNET WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, LOST DATA, MISSED COMMUNICATIONS, FAILURE OF THIRD-PARTY WEBSITES OR SERVICES, OR FAILURES OF CUSTOMER-OWNED EQUIPMENT, EVEN IF RELIABLE INTERNET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, Reliable Internet's liability arising from a Service interruption will not exceed the prorated amount the Customer paid for the affected Service during the period of interruption. This limitation establishes a maximum potential liability and does not create an automatic right to an outage credit.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
14. Events Outside Reliable Internet's Reasonable Control
Reliable Internet is not responsible for failure or delay caused by events outside its reasonable control, including severe weather, lightning, flood, fire, power outages, fiber cuts, tower damage, upstream carrier outages, third-party network failures, government action, civil emergencies, labor disruptions, war, terrorism, natural disasters, or equipment failures outside Reliable Internet's reasonable control.
Reliable Internet may depend on upstream carriers, utilities, Internet backbone providers, tower facilities, and other third parties. Reliable Internet is not liable for outages or failures caused by third parties outside Reliable Internet's reasonable control.
15. Changes to Terms and Pricing
Reliable Internet may revise these Terms, the AUP, and related policies from time to time. Updated versions may be posted on Reliable Internet's website and will state an effective date. Material changes may become effective upon posting to the extent permitted by applicable law; changes required by law, regulation, security needs, or network conditions may take effect sooner when necessary.
For recurring monthly price increases, Reliable Internet will provide at least 30 days' advance notice. Notice may be provided by website notice, email, invoice, billing statement, or another reasonable method.
16. Notices and Contact Information
Email sent to the address on the Customer's account and notices posted to an available customer portal may constitute official notice. Customers are responsible for keeping their contact information current.
Customer notices to Reliable Internet may be provided by email to reliableinternet2@gmail.com, by text message to (269) 838-8338, or by mail to the address in Section 19, except where a different method is required by law.
17. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS.
Before starting arbitration, either party should provide written notice describing the dispute and requested resolution and allow the other party a reasonable opportunity to resolve the matter informally.
Except for claims eligible to be brought in small claims court and matters that applicable law does not permit to be arbitrated, any dispute arising out of or relating to the Service, these Terms, billing, installation, equipment, or the parties' relationship will be resolved by binding arbitration administered by the American Arbitration Association ("AAA"). Arbitration involving an individual residential consumer will be conducted under the AAA Consumer Arbitration Rules then in effect. Arbitration involving a business customer will be conducted under the AAA Commercial Arbitration Rules then in effect, unless the parties agree otherwise.
The arbitration will be conducted in or reasonably near Ionia County, Michigan, unless the applicable AAA rules or law require another location or permit remote proceedings. The arbitrator may award any remedy available under applicable law. Arbitration fees and costs will be allocated under the applicable AAA rules and applicable law.
This arbitration provision does not prevent either party from seeking temporary or emergency relief from a court when necessary to protect property, network security, confidential information, or legal rights while arbitration is pending.
18. General Provisions
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, subject to applicable federal law. To the extent a dispute is not subject to arbitration, the parties consent to jurisdiction in courts having authority over Ionia County, Michigan.
A new owner or occupant of a service location must establish a new account with Reliable Internet. Reliable Internet may assign or transfer its rights and obligations under the agreement in connection with a sale, reorganization, merger, financing, or transfer of assets or business operations.
If any provision is held unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
